Amendment IX
The enumeration in the Constitution, of certain rights, shall not be
construed to deny or disparage others retained by the people.

The people have the right of education…. because it’s never given to
the Federal Government. So the right of the Congress to create
Departments, doesn’t allow them the power to infringe on our right to
our own choice and power over our education.
